Welcome to FourCapitalRentals.com (the "Site"), operated by Four Capital Rentals ("we," "us," or "our"). By accessing or using the Site, or by engaging our vehicle rental services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site or our services.
1. Overview of Services
Four Capital Rentals provides vehicle rentals for personal and commercial use, including use with rideshare and delivery platforms (e.g., Uber, Lyft, DoorDash). Use of the Site to submit inquiries, applications, or lead forms does not guarantee approval for a rental.
2. Eligibility
To use our services, you must:
Be at least 21 years of age
Hold a valid, unexpired driver's license
Provide accurate and truthful information during the application process
Meet any additional requirements outlined in your Rental Agreement
3. Rental Agreement Governs
Any vehicle rental is governed by a separate, signed Rental Agreement and any applicable addenda (including but not limited to a damage waiver addendum). In the event of a conflict between these Terms and a signed Rental Agreement, the Rental Agreement controls for matters related to the rental itself.
4. Website Use
You agree to use the Site only for lawful purposes. You may not:
Submit false or fraudulent information through any form on the Site
Attempt to interfere with the security or functionality of the Site
Use automated systems (bots, scrapers) to access the Site without our permission
Use the Site to harass, defraud, or harm us or any third party
5. No Guarantee of Availability
Vehicle availability, pricing, and rental terms displayed on the Site are subject to change without notice. Submitting an inquiry does not reserve a vehicle.
6. Payments
Accepted payment methods, deposit requirements, and pricing are outlined in your Rental Agreement. All payments are due as specified in that agreement. Late or missed payments may result in fees, vehicle recovery, or termination of the rental as described in your Rental Agreement.
7. Communications Consent
By submitting your contact information through the Site, you consent to receive calls, texts, and emails from us regarding your inquiry or rental, including automated or marketing messages. Message and data rates may apply. Reply STOP to opt out of texts at any time.
8. Intellectual Property
All content on the Site — including text, graphics, logos, and images — is owned by or licensed to Four Capital Rentals and may not be copied, reproduced, or distributed without our written permission.
9. Disclaimer of Warranties
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not guarantee the Site will be error-free, secure, or uninterrupted.
10. Limitation of Liability
To the fullest extent permitted by law, Four Capital Rentals shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Liability related to vehicle rentals is governed separately by your Rental Agreement.
11. Indemnification
You agree to indemnify and hold harmless Four Capital Rentals, its owners, and employees from any claims, damages, or expenses arising from your misuse of the Site or breach of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
